PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 130 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 8(c) read with 20(b)(ii)(B) and Section 25 of the NDPS Act, in Crime No.130 of 2022, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused persons were in possession of 1.5 kg of Ganja. On seeing the police party, they fled away from the place. The petitioner is the first accused. The contraband was recovered from the second accused. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offences. He has been falsely implicated in this case, on the basis of the confession given by the second Accused.

4.The learned Additional Public Prosecutor would submit that the petitioner is having one previous case in the similar nature and he vehemently opposed to grant relief to the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.8345 of 2022 5.Considering the facts and circumstances of this case and also considering the previous case pending against the petitioner, this Court is not inclined to grant relief to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed.
