ORDER

Today, when the criminal original petition is taken up for hearing, learned Counsel appearing on either side submitted that the issue has been settled amicably in the Lok Adalat held at Thuraiyur on 12.11.2016 and therefore, they do not want to proceed with the present case.

2. At this juncture, Advocate Commissioner - Mr.RM.Arun Swaminathan intervened and submitted that based on the directions of this Court dated 21.01.2016, he has inspected the spot and submitted his report dated 09.02.2016 and therefore, sought for additional remuneration.

3. Perusal of record shows that this Court, vide order dated 21.01.2016, has appointed Advocate Mr.RM.Arun Swaminathan, as Commissioner, to visit the spot in question and appraise the https://hcservices.ecourts.gov.in/hcservices/

present condition of the building and nature of the work being carried on. His initial remuneration was fixed as Rs.10,000/- to be paid by the petitioner and fourth respondent (each Rs.5,000/-). Pursuant to the same, the Advocate Commissioner has visited the spot and submitted his detailed report dated 09.02.2016. Considering the nature of work as well as the report of the Advocate Commissioner, this Court fixes a sum of Rs.10,000/- as additional remuneration to the Advocate Commissioner, which shall be paid by both the petitioner and the fourth respondent (each Rs.5,000/-).

4. With these observations, recording the submission made by the learned Counsel on either side, this Criminal Original Petition stands closed.
