ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 25.07.2024 for the offences punishable under Sections 8(c) r/w 20(b) (ii) (c), 25 & 29(1) and 25 of Narcotic Drugs & Psychotropic Substances Act, C.C.No. 262/2024 on the file of the II Additional Special Court for Trial of NDPS Act Cases, Madurai in Crime No. 02/2024 on the file of the Respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner along his friends were in illegal possession of 529 kilograms of Ganja . Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and he is in judicial custody from 27.05.2024. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that this case involves seizure of 529 kilograms of Ganja, which was seized only from the petitioner and his friends and also submitted that four previous cases are pending against the petitioner.

5. The petitioner seeks bail on medical grounds. Therefore, this Court directed the respondent police to assess the petitioner's health condition and submit a report before this Court.

6. Pursuant to the directions of this Court, the respondent police submitted a report stating that the petitioner has been receiving proper medical treatment for the past one month and that his condition is now stable. Therefore, the petitioner's request for bail on medical grounds is rejected.

7. Considering the nature of the allegations, namely that the seizure involves a large quantity of 529 kgs of Ganja and that the petitioner was arrested while in possession of the contraband and there are four previous cases are pending against the petitioner, this is not a fit case for the grant of bail 3/5
