Whereas the above said petitioner filed the Second Appeal is filed under section 100 of Civil Procedure Code, praying this Hon'ble Court against the judgment and decree passed in A.S.No.23 of 2005 dated 30.08.2006 on the file of the Principal Sub Court, Tenkasi reversing the judgment and decree passed in O.S.No.8 of 2002 dated 27.04.2004 on the file of the Additional District Munsif Court, Tenkasi.

(Mobile No.7010067756) as Advocate Commissioner, to inspect the suit property and note down the physical features, particularly, the exact location of the road that has been laid pursuant to exhibit A13 dated 28.03.2001 in suit items 1 and 2 by the municipality.

2. You are informed that the Tahsildhar, Kadayanallur is directed to make available a revenue surveyor to assist the Commissioner in measuring and demarcating the road portion in suit items 1 and 2.

3. You are further informed that Initial remuneration for the Advocate Commissioner is fixed as Rs.25,000/- (Rupees Twenty Five thousand only) to be paid by the appellants and the same will be taxed as costs in the appeal. The commissioner is directed to file his report by 07.01.2019.

The Advocate Commissioner is directed to issue notice to the learned counsel appearing for the parties before undertaking his visit.
