PRAYER :- For Bail in Crime No.493 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1 herein was arrested and remanded to judicial custody on 23.07.2020 for the alleged offences under Sections 394 r/w.397 of IPC.

2. There are totally four accused in this case. The petitioner herein is arrayed as A1. The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant, assaulted him and extracted Rs.500/- from the defacto complainant. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him.

4. The learned Government Advocate(Crl.Side) would submit that the petitioner is a habitual offender and he is having seven previous cases for various offences. If he is released on bail,he will abscond again and indulge in similar type of offence.

5. Taking into consideration the fact that petitioner is a habitual offender having seven previous cases for various offences, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
