2. The learned counsel appearing for the petitioner submitted that the first respondent was already set exparte in MCOP No.11 of 2021 and the liability is as against the second respondent alone. Further the first respondent is a formal party and therefore no notice required for him, for which, he has also filed a memo and the same is recorded. Second respondent was served with notice and name printed in the cause list. 3.Being satisfied with the reasons stated in the accompanying affidavit, this petition is ordered and the delay is condoned.
