PRAYER :- This Second Appeal is filed under Section 100 of the Civil Procedure Code, to set aside the decree and judgment in A.S.No.16 of 2014 on the file of the Sub Court, Devakottai, dated 14.11.2017, confirming the judgment and decree passed in O.S.No.2 of 2010 on the file of the District Munsif Court, Devakottai, dated 22.11.2013.

JUDGMENT

The appellant filed this appeal to set aside the decree and judgment in A.S.No.16 of 2014 on the file of the Sub Court, Devakottai, dated 14.11.2017, confirming the judgment and decree passed in O.S.No.2 of 2010 on the file of the District Munsif Court, Devakottai, dated 22.11.2013.

2. When the matter is taken up for hearing today (15.03.2024), the learned counsel appearing for the appellants submits that the matter has already been settled between the parties out of Court and prayed to dispose of the appeal as settled out of Court. He has also filed a memo to that effect along with a letter given by the appellant.

3. In view of the same, the said memo is recorded and this Second Appeal is dismissed as settled out of Court. No costs. Consequently, connected Miscellaneous Petition is closed.
