ORDER : The Court Made the following order :- The petitioner is in judicial custody since 22.09.2018 for the offences punishable under Sections 392 r/w 397 I.P.C, in Crime No.525 of 2018, on the file of the respondent police. He seeks bail.
2.The case of the prosecution is that the petitioner and other accused persons were kidnapped one Dhanabal, who is the brother of the defacto complainant for ransom. Hence, the case has been registered.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent. He did not commit any offence as alleged by the prosecution. He has been falsely implicated in this case. Further, he would submit that the co-accused released on bail by the Court below. The petitioner is in incarceration from 22.09.2018 onwards. Hence, he prays for grant of bail. 4.The learned Additional Public Prosecutor appearing for the respondent police submits that the investigation is pending and there is no previous case pending against the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to enlarge the petitioner on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions;
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Trichy, Trichy District.
(iii) the petitioner shall appear before the respondent police daily at 10.30 a.m until further orders.
