PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No.207 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 24.04.2021 for the offences punishable under Sections 381, 120(b), 411, 414 r/w Section 34 IPC in crime No.207 of 2021, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner is working in Gold Loan Section of HDB Financial Service, at Pudukkottai Branch and he has conspired with other accused, who were the employees of the aforesaid financial company and stolen jewels from the safety locker of the Company from 01.09.2020 to 21.04.2021, totally weighing 2716.91 grams. At the time of audit, the said theft was found and it was also revealed that the accused persons had re-pledged the said jewels in Indel Money Private Limited. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. would further submit that the petitioner is in jail from 24.04.2021, hence he may be granted bail.

4.Mr.M.Kannan, learned counsel appeared on behalf of the defacto complainant, but, no application has been filed. 5.The learned Government Advocate(Crl.Side) would submit that there are totally 5 accused in this case and the petitioner herein is arrayed as A1. He would also submit that at the time of audit in the aforesaid company, it was found that 2716.96 grams gold jewels were missing and the investigation in this case is in preliminary stage. Hence, he strongly opposed this petition. 6.Considering the nature of serious allegations and also considering the quantum of jewels involved in this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
