Prayer : Criminal Original Petition is filed under Section 482 of Criminal Procedure Code/Section 528 of BNSS, 2023, to call for the records in connection with PRC No.12 of 2023 on the file of the Additional Mahila court, Sivagangai District and quash the same.

ORDER
The petitioners seek to quash the final report in PRC.No.12 of 2023 dated 09.12.2020 on the file of the Additional Mahila court, Sivagangai District, which was filed for the offences under Sections 147, 148, 448, 323, 324, 506(ii), 379 and 294(b) of IPC and Section 4 of TNPHW Act, 2002 and Section 3 of TNPPDL Act.

The allegation in the final report is that the petitioners and the defacto complainant are neighbours; that on account of a dispute regarding bursting of crackers, petitioners trespassed into the house of the defacto complainant, caused damaged to a car, attacked the de-facto complainant and snatched her gold chain and thus, committed the aforesaid offences. 2/5
3. Admittedly, the petitioners and the defacto complainant are neighbours and they have entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 29th July 2024.
4. The petitioners and the second respondent, namely, R.Sagunthala @ Sowundhala (Aadhaar No.7543 5718 2017), are present before this Court in person. They are identified by Mr.S.Alagu Boopathi, Special Sub-Inspector of Police, Kalaiyarkoil Police Station, Sivagangai District. All the parties confirmed the compromise arrived at between them.

In view of the same, considering the nature of the offences and since the dispute is private in nature, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in PRC.No.12 of 2023 dated 09.12.2020 is quashed and the Criminal Original Petition stands allowed. The petitioners shall pay a sum of Rs.2,000/- (Rupees Two Thousand only) each as costs to the High Court Legal Services Authority attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the 3/5
