Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to conduct survey and subdivision of Survey No.415/1A, Pattinamkathan Village, Ramanathapuram Taluk, Ramanathapuram District to admeasuring 6 cents on the basis of the petitioner's application dated 13.02.2025 and consequently direct the 1st respondent to issue patta to the petitioner based on her documents within a time frame that may be stipulated by this Court.

ORDER

I have heard the learned counsel appearing for the petitioner and Mr.C.Satheesh, learned Government Advocate appearing for the respondents.

Though the writ petitioner seeks issuance of a Writ of Mandamus to direct the respondents to conduct Survey and subdivide survey numbers 415/ 1A, the writ petition is taken up for admission, the learned Government Advocate appearing for the respondents, on instructions, would submit that the Survey No.415/1A has already been sub-divided into several subdivisions. Hence, the application of the petitioner seeking survey in respect of survey number 415/ 1A cannot be acted upon, especially, since the sale deed in favour of the petitioner reflects only survey number 415/1A before subdivision and further, the patta also does not stand in the name of the petitioner, despite purchase of subject lands by the petitioner way back on 10.08.2009. 2/5

In view of the above, liberty is granted to the petitioner to seek for separate patta based on the patta issued to the petitioner's vendor and thereafter, the petitioner shall approach the respondents for conducting the survey based on the application already made on 13.02.2025. In a application made for transfer of patta by the petitioner, within a period of two weeks from the date of receipt of a copy of this order, shall be expeditiously processed by the first respondent and final orders be passed, within a period of four weeks, thereafter.

4. With the above direction, the writ petition is disposed of. No costs.
