PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.130 of 2023 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused No.3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, in Crime No.130 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the de-facto complainant is that the respondent Police along with the police party involved in a vehicle checkup near Karukkanpatti Masanam Road, while so, the respondent Police caught hold Accused Nos.1 and 2 and found that they were in possession of 4.500 kgs of Ganja in a gunny bag. After the seizure of the contraband, the defacto complainant lodged the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the said offence and at that time, he was working as a lorry driver at Vijayawada and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the investigation is under progress and opposed for granting anticipatory bail to the petitioner.

5. Heard. Perused the materials available on record including the First Information Report.

6. It is seen that there are totally three accused, in which the petitioner is arraigned as the third accused. The first accused was found in possession of 4.500 kgs of Ganja and the second accused was found in possession of 1.5 kgs of Ganja and they were arrested and remanded to judicial custody and on their confession, the petitioner has been implicated as an accused. That apart, the petitioner has been involved in another NDPS Act. Therefore, the custodial interrogation of the petitioner is very much required in this case. Accordingly, this Criminal Original Petition is dismissed.
