Petition filed under section 439(1)(b) r/w 482 of Cr.P.C. Praying this Hon'ble Court to relax the condition imposed on the petitioner by the learned Principal District and Sessions Judge, Ramanathapuram in Crl.M.P(MD) No.1438 of 2018 dated 26/07/2018. ORDER:

This Petition is coming on for orders on this day and upon perusing the petition and upon hearing the arguments of Mr.R.Murugan, Advocate for the petitioner and of Mr.K.Suyambulinga Bharathi, Government Advocate, for the respondent, the Court made the following order:

The Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner by the learned Principal District and Sessions Judge, Ramanathapuram in Crl.M.P.(MD)No.1438 of 2018 and subsequently modified by this Court in Crl.O.P.(MD) No.14635 of 2018, dated 20.08.2018.

2. When the matter is taken up for hearing, the learned Government Advocate (crl.side) appearing for the respondent, on instructions, would submit that the petitioner is complying with the conditions regularly from 06.10.2018 to till date. submit that investigation in the above case has been completed and charge sheet has been filed, which has been taken on file as PRC.No.31 of 2018, which is pending on the file of the learned Judicial Magistrate No.2, Ramanathapuram.

3. In the light of the submissions made by the learned Government Advocate (crl.side), this petition is allowed and the condition already imposed on the petitioner is modified to the effect that the petitioner to appear before the committal Court on all hearing date without fail, till the case is committed.
