This Criminal Original Petition has been filed praying for a direction to the learned 2nd Additional Sessions Judge for SC/ST (POA)Act, PCR Court, Tirunelveli, to consider the bail application of the petitioner on the same day of his surrender in Crime No. 149 of 2021 on the file of the first and second respondents police. 2.The petitioner is the second accused in Crime No.149 of 2021 on the file of the second respondent for the offences punishable under Sections 294(b), 436 & 506(ii) I.P.C and Section 4 of the Prohibition of Harassment of Women Act, 2002 and Sections 3 (1)(r), 3(1)(s) and 3(2)(iv), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. 3.Mr.M.Muthumanikkam, learned Government Advocate (criminal side) accepts notice for the respondents 1 and 2. 1/3
4.Considering the facts and circumstances of the case, this Court is inclined to pass the following orders :- i)The petitioner shall appear before the learned 2nd Additional Sessions Judge for SC/ST (POA) Act, PCR Court, Tirunelveli, within a period of one month, from the date of resumption of regular work in subordinate Courts.
ii)On such surrender along with notice served to the defacto complainant, the concerned Judge shall consider the bail application filed by the petitioner and pass orders on merits on the same day of his surrender, after hearing the defacto complainant by complying with Section 15A of the Act. 5.With the above observation, this Criminal Original Petition is disposed of.
