PRAYER: Criminal Original Petition is filed under Section 482 of BNSS Act, to direct the learned Judicial Magistrate, Paramakudi, to dispose of the case in CC.No.341/2024 on the file of learned Judicial Magistrate, Paramakudi, within a stipulated time that may be fixed by this Court. ORDER

The present petition has been filed by the accused person in C.C.No.341 of 2024 on the file of the learned Judicial Magistrate, Paramakudi, seeking expeditious disposal of the case wherein the petitioner is charged with the offences under Section 304(A) of IPC.

2. According to the learned Counsel appearing for the petitioner, the defacto complainant has filed M.C.O.P.No.33 of 2017 and a sum of Rs.23,00,000/- has been awarded and it has not been taken up on appeal by the Insurance Company and therefore, the defacto complaint is not regularly appearing before the Court.

3. Per contra, the learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner/accused was absent on several occasions and NBW was issued and only now NBW has been recalled after he had surrendered before the Court.

4. Considering the above said facts, there shall be a direction to the learned Judicial Magistrate, Paramakudi, to expeditiously dispose of C.C.No. 2/4

341 of 2024 on or before 31.07.2026.

5. With the above said observations, this Criminal Original Petition stands disposed of.
