ORDER : The Court Made the following order :- The petitioner, who is arrayed as A8 was arrested and remanded to judicial custody on 01.02.2016 for the alleged offence punishable under Section 8(c) r/w 20(b)(ii)(B), 25, 29 of NDPS Act, in Crime No.14 of 2016 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the accused had illegally transported Ganja more than 19 kgs.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.Per contra, the learned Government Advocate (Criminal side) submitted that the accused were found in possession of more than 19 kgs of Ganja and therefore, as per section 37 of NDPS Act, the accused are not entitled for bail. It is further submitted that the petitioner/A8 is a citizen of Srilangan, if the petitioner is enlarged on bail, he may abscond and hence, prayed for the dismissal of the bail petition.

5.Considering the facts and circumstances of the case, this court is not inclined to grant bail to the petitioner and hence, this petition is dismissed.
