This Criminal Original Petition has been filed seeking orders to grant special leave to the petitioner to file the appeal against the judgment of acquittal passed in C.C.No.576 of 2017, dated 03.07.2023 passed by the learned Judicial Magistrate Fast Track Court at Magistrate Level, Karur. 1/2 https://www.mhc.tn.gov.in/judis

2. The petitioner/complainant filed a complaint for the offence under Section 138 of Negotiable Instruments Act and after trial, the learned Magistrate has passed the judgment, dated 03.07.2023, acquitting the respondent/accused and that therefore, the petitioner was constrained to file the above appeal.

3. Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondent and also perused the affidavit filed in support of the petition and the impugned judgment. 4.Considering the submissions made by the learned counsel on either side and also the reasons assigned, this Court is inclined to grant leave to the petitioner.

5.Accordingly, the Criminal Original Petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and list the matter in the regular course.
