ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offence punishable under Section 394 of I.P.C., in Crime No.256 of 2007, on the file of the respondent police and seeks anticipatory bail.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.
3.The petitioner is shown as accused in P.R.C.No.24 of 2007, on the file of the Judicial Magistrate, Thirumangalam. He has been absconding for very long number of years. According to the learned Counsel for the petitioner the petitioner was working in Kerala. The petitioner Counsel undertook that the petitioner would attend all future hearing dates and would not even file an application under Section 317 of Cr.P.C.
4.The learned Counsel for the petitioner further gave an undertaking on instructions that the petitioner would attend the hearing till conclusion of the trial. If this undertaking is breached, this order would stand cancelled automatically. https://hcservices.ecourts.gov.in/hcservices/
5.In view of the undertaking given by the petitioner, the petitioner is permitted to appear before the concerned Magistrate Court on the next hearing date and to file a recall warrant petition. The concerned Magistrate is directed to recall the warrant on the same day.
