PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus to direct the first respondent to revoke the contracts of sanitary works and public toilet maintaining from the individual persons and private organizations and to direct the second respondent to execute the special development programme to organize the scavengers who is working for Madurai Corporation as daily wager into self-help groups and assist them to take part in contracts of sanitary works and public toilet maintaining in Madurai Corporation through self-help works and establish the economic equality among people based on the petitioner's representation dated 04.03.2024.

[Order of the Court was made by The Hon'ble ACTING CHIEF JUSTICE] Prayer in this writ petition is to direct the first respondent to revoke the contract of sanitary works and public toilet maintaining works from the individual persons and private organizations and to direct the second respondent to execute the special development programme to organize the scavengers, who are working for Madurai Corporation as daily wagers into self-help groups and assist them to take part in the contract of sanitary works and public toilet maintaining in Madurai Corporation through self-help works and establish the economic equality among people based on the petitioner's representation dated 04.03.2024.

2. Today, when the matter is taken up for hearing, learned counsel for the petitioner submitted that it would suffice if a direction is given to the third respondent to consider the representation of the petitioner dated 04.03.2024 and pass orders on merits and in accordance with law.

3. Learned Government Pleader appearing for the respondents 1 & 2 and learned Standing Counsel appearing for the third respondent have no objection for the above submission of the learned counsel for the petitioner.

4. Taking into consideration the limited scope of the relief sought for by the petitioner, without going into the merits of the matter, we direct the third respondent to consider the petitioner's representation dated 04.03.2024 and pass orders on merits and in accordance with law, after affording due opportunity to the parties concerned. Such an exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
