ORDER
This writ petition has been filed praying to issue a Writ of Mandamus, to direct the respondents to take action by considering the representation preferred by the petitioner dated 21.05.2021 in accordance with law within the time stipulated by this Court. 2.The case of the petitioner is that he owned TATA 1212 four wheeler vehicle bearing registration No.TN 59 CJ 8946 and used the same on rental basis. On 18.04.2021, one Subramani loaded 112 electronic articles from VG Cargo Parcel Service Company to deliver the same to Vasanth & Co., Karaikudi Branch, Sivagangai District and other companies at Paramakudi and Ramanathapuram. The said 112 number of electronic articles belong to Haier Applications India Pvt.Ltd.
It was informed by the driver that on 18.04.2021 at about 11.00 pm., the vehicle reached Mathur toll gate and therefore he decided to sleep in vehicle and parked the vehicle 50 meters from the toll. On 19.04.2021, morning he woke up and continued his journey and when he delivered the electronic goods to Vasanth & Co., https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.9907 of 2021 Karaikudi Branch, it was found that 21 numbers of LED TV were missing. The value of 21 LED TV is Rs.4,00,000/-. Thereafter, it was found that the "Tharpai" of the lorry was torn and somebody had stolen the televisions, when the vehicle was parked at the toll gate. In this regard, the petitioner gave representation to the respondent police on 21.05.2021 for finding the stolen articles. However, there is no action on his representation. Therefore, this petition came to be filed. The petitioner also filed the copy of the complaint preferred by him and photocopy of the lorry. 3.The learned Government Advocate(Crl.side) appearing for the respondents submitted that the representation dated 21.05.2021 received and it is pending enquiry.
4.Recording the said submission, this Court directs the respondents, especially, the second respondent to conduct proper and thorough investigation with regard to the alleged theft of 21 numbers of LED TV from the lorry owned by the petitioner and take appropriate action, in accordance with law, within a period of one month and inform the outcome of the investigation to the petitioner, immediately. Accordingly, this writ petition is ordered. No costs.
