Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to reissue passport to the petitioner by processing the online application vide application reference (ARN) No:22-1004286263 dated 20.04.2022 within the time framed as fixed by this Court. O R D E R

The petitioner is a holder of Indian passport. The period expired on 02.09.2020. He seeks re-issuance of the same. The first respondent had declined to comply with the petitioner's request citing the pendency of a criminal case.

2. The learned Special Government Pleader appearing for the second respondent submitted that crime No.466 of 2014 registered against the petitioner has culminated in C.C.No.4302 of 2022 on the file of the Special Court, CBCID, Egmore. Since the petitioner is presently facing trial, it is only the trial Court that has to pass necessary orders.

3. The petitioner is given liberty to move the trial Court concerned seeking the relief now sought for before this Court. On such application being filed, the same shall be disposed of by the https://hcservices.ecourts.gov.in/hcservices/ 1/4

2 W.P.(MD)NO.8891 OF 2022 trial Court concerned on merits and in accordance with law within a period of three weeks thereafter.
