2.The learned Government Advocate (Crl. Side) would submit that now the matter has been posted before the competent authority for arguments. Whatever may be, the defence that is available with the petitioner can be raised before the competent authority at the time of arguments.

3.Since the matter is posted for arguments before the competent authority, the proceedings cannot be quashed at this time. Depending upon the outcome of the enquiry, the petitioner can workout his remedy in the manner known to law.
