PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records pertaining to the charge sheet in C.C.No.125/2025 on the file of the Judicial Magistrate Court, Periyakulam and quash the same as far as this petitioner is concerned.

ORDER

The present petition has been filed by the accused person in C.C.No.125 of 2025, on the file of the respondent police wherein the petitioner is charged with the offences under Section 279 and 304(A) of IPC.

2. A perusal of the charge sheet reveals that the petitioner is a Driver of the transport Corporation bus and he had driven the vehicle in a rash and negligent manner and dashed as against the two wheeler in which the deceased person was travelling.

3. According to the learned Counsel appearing for the petitioner, only the deceased person was driving the vehicle in a rash and negligent manner and he had entered into the road way meant for the bus coming from the opposite direction. Hence, he prayed for quashing of the charge sheet.

4. I have considered the submissions made on either side and perused the materials available on record.

5. The submissions made on behalf of the petitioner is relating to the disputed fact and this can be proved only during trial. This Court cannot quash the charge sheet on the submissions raised on the side of the petitioner.

6. There are no merits in the petition. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petitions are also closed.
