ORDER

(Order of the Court was made by the Hon'ble A.D.Jagadish Chandira, J.) Learned Counsel for State of Tamilnadu(Crl.Side) appearing for the petitioner would submit that the prosecution has proved the theory of last seen together and the motive has https://www.mhc.tn.gov.in/judis

also been proved, whereas, the accused have not come out with the explanation regarding the same while questioning under Section 313 Cr.P.C. Further, it is a case of gruesome murder where the head of the deceased was severed from the torso and the body was also indiscriminately cut into pieces. Without considering the same, the trial Court relying upon the stray answers elicited during cross examination, has acquitted the accused persons. The finding of the learned trial Judge is illegal and perverse. Hence, he prays for leave.

2. Learned counsel for the respondents would submit that the trial Court taking into consideration the entire evidence on record has rightly found the accused not guilty and acquitted them.

3. Having gone through the records, this Court is inclined to grant leave.

4. Accordingly, this petition is allowed.
