PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1, 2 & 3 to settle my surrender leave salary so far not given by the respondent Corporation for 115 days for the value of Rs.1,51,897.00 (Rupees One Lakh Fifty one Thousand Eight hundred and Ninety seven only) in respect of the years 2011 to 2023 together with interest at the rate of 18 % per annum payable from the date for retirement to till the date of actual payment. This Writ Petition has been filed seeking a Writ of Mandamus, directing the respondents 1, 2 & 3 to settle my surrender leave salary so far not given by the respondent Corporation for 115 days for the value of Rs.1,51,897.00 (Rupees One Lakh Fifty one Thousand Eight hundred and Ninety seven only) in respect of the years 2011 to 2023 together with interest at the rate of 18 % per annum payable from the date for retirement to till the date of actual payment. 2/4
2. A perusal of the records reveal that the petitioner had attained superannuation on 31.05.2023. However, his surrender leave salary was not paid, due to paucity of fund. The petitioner has sent a representation on 25.03.2025, seeking the above said benefits. So far, there is no response from the authorities, the present writ petition has been filed.
3. Considering the above said facts, the respondents herein are directed to disburse the eligible surrender leave salary of the writ petitioner along with 6% interest from the due date till the date of disbursement within a period of twelve
(12) weeks from the date of receipt of a receipt of a copy of this order. 4.With the above said observations, this writ petition stands disposed of. No costs.
