ORDER : The Court Made the following order :- The petitioner, who arrayed as accused was arrested and remanded to judicial custody on 08.12.2015 for the alleged offences punishable under Sections 294(b),307,427 and 506(ii) of IPC in Crime No.204 of 2015, on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that the petitioner abused the defacto complainant in filthy language and tried to stabbed on the neck of the defacto complainant at knife and damaged the bottles worth about Rs.500/- and threatened to kill him with dire consequences.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.
4. The learned Government Advocate (Crl.side) submitted that the petitioner was already enlarged on bail by this Court in Crl.O.P(MD). No.138 of 2015, dated 07.01.2016, in Crime No.138 of 2015 and he further https://hcservices.ecourts.gov.in/hcservices/ submitted that no one has sustained injury in this crime number.
5. Considering the facts and circumstances of the case and also considering the fact that no one has sustained injury in this Crime number, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Vilathikulam and on further condition that the petitioner shall appear before the respondent Police daily at 10.00 am until further orders.
