Respondents PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents not to construct the fair price shop inside the park situated in Church Road, Anna Nagar, Madurai and further direct the 2nd respondent to develop and maintain the same as park without any construction.

O R D E R

[Order of the Court was made by S.NAGAMUTHU, J.] The petitioner has come up with this Public Interest Litigation seeking a direction to the respondents not to construct the fair price shop inside the park situated in Church Road, Anna Nagar, Madurai.

2.When the matter was taken up for hearing today, the learned counsel for the petitioner produced a letter of the Commissioner, Madurai Corporation in Ref.No.Ma.Po.2/ma.sa.1/35425/15, dated 04.12.2015, wherein he has informed the petitioner that the proposal to construct the ration shop inside the park has already been dropped. The same is recorded.

3.In view of the above, nothing survives in this writ petition. This Writ Petition is, therefore, dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also dismissed.
