ORDER

This Criminal Original Petition is filed seeking a direction to the respondent police to produce the Petitioner's vehicle bearing Registration No. TN-72-BQ-4851 before the concerned Judicial Magistrate Court.

2. The grievance of the petitioner is that he is the owner of the vehicle bearing Registration No. TN-72-BQ-4851 and the vehicle was seized by the respondent police on 28.02.2021 on the basis of the F.I.R registered in Crime No.39 of 2021 dated 28.02.2021 stating that the vehicle was used for the purpose of transporting 20 plastic bags of ration rice without valid permission and document. The vehicle was not produced before the concerned Court. So, he filed this petition.

3. The learned Public Prosecutor would submit that due to the lock down, vehicle was not produced before the concerned Court immediately and now the proceedings are underway. However, the remedy available to the petitioner is to file a petition under Section 457 of Cr.P.C before the jurisdictional Magistrate Court seeking proper relief.
