Prayer in CMP(MD)No.6599 of 2026 : This Civil Miscellaneous Petition filed under Section 151 of Civil Procedure Code praying to pass appropriate orders by allowing this petition and thereby permit the petitioner to withdraw the 50% of deposited amount along with proportionate accrued interest and costs, which was deposited by the first respondent in M.C.O.P.No.119 of 2018 on the file of the Motor Accident Claims Tribunal / Sub Court, Lalgudi, Tiruchirappalli District. Prayer in CMA(MD)No.1344 of 2024 : This Civil Miscellaneous Appeal filed under Section 173 of the Motor Vehicle Act praying to set aside the judgment and decree passed in M.C.O.P.No.119 of 2018 dated 29.04.2024 on the file of the Motor Accidents Claim Tribunal, Lalgudi (Subordinate Judge / Presiding Officer, Lalgudi M.C.O.P.No. 119 of 2018) and allow this civil miscellaneous appeal. ORDER

The above petition has been filed seeking orders to permit the petitioner to withdraw 50% of the amount along with proportionate accrued interest and costs, which was deposited by the first respondent.

2. No representation for the respondents 2 and 3.

3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

4. It is evident from the records that this Court in C.M.P.(MD)No.14403 of 2024 vide order dated 23.10.2024 directed the first respondent to deposit 50% of the award amount to the credit of M.C.O.P.No.119 of 2018 on the file of the Motor Accident 2/3

Claims Tribunal / Sub Court, Lalgudi. In pursuance of the said direction, the first respondent deposited the said amount.

5. Considering the submissions made on either side, the petitioner is permitted to withdraw 50% of the award amount with accrued interest and costs on filing necessary application before the Tribunal.

6. Accordingly, this petition is ordered.
