The petitioner has approached this Court that the second respondent police is harassing her under the guise of enquiry. 2.The learned Additional Public Prosecutor submits that the second respondent police has conducted an enquiry based on the complaint of the third respondent, which was forwarded by the Commissioner of Police in C.No.177/COP/Camp/PG-C/Tin-C/2024, dated 05.03.2024. 3.If the complaint denotes a cognizable offence, the second respondent police is entitled to register a case. In the event, if they are registering the case, the second respondent police shall summon the petitioner under Section 41-A of Cr.P.C. for the enquiry. Before registration of the case, the appearance of the petitioner is not necessary. 4.With the above observation, this petition is allowed with a direction to the second respondent not to harass the petitioner. 16.04.2024 NCC : Yes/No Index : Yes/No Internet:Yes sji 2/4
