This petition has been filed to direct the Judicial Magistrate No.2, Srivilliputtur, Virudhunagar District to expedite and complete the trial in C.C.No.88 of 2014 on the file of the Judicial Magistrate No.2, Srivilliputtur, Virudhunagar District within a stipulated time as fixed by this Court.
2. Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.Side) appearing for the State.
3. It is seen that the petitioner is facing trial under Section 498(A), 323 I.P.C. r/w Section 4 of Dowry Prohibition Act in C.C.No.88 of 2014 before the learned Judicial Magistrate No.2, Srivilliputtur, Virudhunagar District. On a reading of the "B" diary extracted, it is seen that the trial Court issued summons to L.W.1 to L.W.3 from the year 2014 onwards, despite which, the prosecution has not been able to produce them before the Court. Hence, this Court directs the respondent police to take steps to serve summons on L.W.1 to L.W.3 and produce them before the Court for their examination. The learned Judicial Magistrate No.2, Srivilliputtur, Virudhunagar District is directed to complete the trial in C.C.No.88 of 2014 within a period of six months from the date of receipt of a copy of this order provided the accused cooperate with the trial Court by engaging an Advocate and crosshttps://hcservices.ecourts.gov.in/hcservices/
examine the witnesses on the date when they are examined in chief as held by the Honourable Supreme Court in Vinod Kumar Vs. State of Punjab, reported in 2015(1) MLJ 288(SC).
