J U D G M E N T

The wife, who is the respondent in H.M.O.P.No.33 of 2017 on the file of the Family Court, Trichy seeks transfer of the same to the Family Court at Madurai. It is claimed by the wife, who is the resident of Virudhunagar and working at Apollo Hospital at Madurai and husband is the permanent resident of Trichy. Even in the original application filed before the Family Court, Trichy, the wife is shown to be a resident of Madurai.

2. Heard both sides and perused the records available.

3. After some arguments, both the learned counsels would concede that H.M.O.P.No.33 of 2017 can be transferred to the Sub Court, Virudhunagar instead of the Family Court, Madurai. Therefore H.M.O.P.No.33 of 2017 is withdrawn from the file of the Family Court, Trichy and transferred to the Sub Court, Virudhunagar. The Family Court, Trichy is directed to despatch the records in H.M.O.P.No.33 of 2017 to the Sub Court Virudhunagar, within a period of two weeks from the date of receipt of a copy of this order.

4. Both the learned counsels assured that the parties shall co-operate for the early disposal of the case. Recording such assurance, the Sub Court, Virudhunagar is directed to dispose of H.M.O.P.No.33 of 2017 on or before 31.12.2017 and report such disposal to this Court.

5. Accordingly, this Transfer Civil Miscellaneous Petition is disposed of. Consequently, connected miscellaneous petition is closed. No Costs.
