CR.No.40/2013 ... RESPONDENT/RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the order dated 18.12.2019 passed by this Hon'ble Court in Crl.MP(MD)No.8086/2019 in Crl.A(MD)No.426/2019 to the effect that the amount of Rs.25,000/- each in favour of the petitioner daughters namely Sivadharshini and Jayadharshini, shall be deposited in the account of Crime No.40 of 2013 (on the file of the respondent police station) in S.C.No.309/2015 (on the file of IV Additional District and Sessions Judge, Madurai) in learned Judicial Magistrate No.6, Madurai at the time of executing the sureties, instead of deposit the amount in name of his daughters.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.S.SATHYA CHIDAMBARAM, Advocate for the petitioner and of Mr.K.DINESH BABU, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the order passed by this Court in Crl.M.P.(MD)No.8086 of 2019 in Crl.A.(MD)No.426 of 2019 dated 18.12.2019.
2.On the side of the petitioner, it is stated that this Court has passed a conditional order on 18.12.2019, directing the petitioner to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each in the name of the children of the deceased, namely, Sivadharshini and Jayadharshini. The petitioner is ready to deposit the amount but the account details was not furnished to the petitioner and prayed this Court to modify the aforesaid condition. https://hcservices.ecourts.gov.in/hcservices/
3.The learned Additional Public Prosecutor has no serious objection in modifying the order.
4.In view of the submission made by the petitioner, this Court is inclined to modify the condition as follows: The petitioner is directed to deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each in the name of minor, namely, Sivadharshini and Jayadharshini before the trial Court. The trial Court (IV Additional District and Sessions Court, Madurai) is directed to deposit the amount in the fixed deposit scheme till the minors attain majority.
5.With the above direction, this petition is allowed. The minors are liable to get the deposited amount by filing proper petition before the trial Court.
