Respondent/Respondent PRAYER: Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code to withdraw H.M.O.P.No.803 of 2018, on the file of the Family Court, Madurai and to transfer the same to the file of the Family Court, Coimbatore to have joint trial along with H.M.O.P.No.1582 of 2018 pending on the file of the Family Court, Coimbatore.

J U D G M E N T

This Transfer civil miscellaneous petition is filed by the wife seeking transfer of H.M.O.P.No.803 of 2018 filed by the husband from the file of the Family Court Madurai, to the file of the Family Court, Coimbatore, to be tried along with the petition filed by her for restitution of conjugal rights in H.M.O.P.No.1582 of 2018.

2. The respondent entered appearance through counsel, who has expressed that he has no objection to the transfer petition.

3. Accordingly, the following directions are issued: i) The Judge, Family Court, Madurai, is directed to transmit the entire records in H.M.O.P.No.803 of 2018 to the file of the Family Court, Coimbatore, within a period of two weeks from the date of receipt of copy of this order.

ii) the learned Judge, Family Court, Coimbatore, after obtaining the records on transfer, is directed to try H.M.O.P.No.803 of 2018 along with H.M.O.P.No.1582 of 2018 and dispose of the same as expeditiously as possible in accordance with law.

4. In the result, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
