Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents No.3 to conduct enquiry and grant patta to the petitioner in Survey No.398/10 to an extent of 4.5 cents situated in Kilaramanathi Village, Kamuthi Taluk, Ramanathapuram District, within a time stipulated by this Court.

ORDER

The petitioner seeks for a direction to the 3rd respondent to grant patta in respect of property situate at Survey No.398/10 measuring an extent of 4.5 cents situated in Kilaramanathi Village, Kamuthi Taluk, Ramanathapuram District. 2.The grievance of the petitioner is that even though patta was earlier granted in respect of a portion of the property, where the petitioner's house is located, the 3rd respondent has not granted patta to the remaining part of the land. 3.Whether the petitioner is entitled to patta for the remaining part of the land or not is for the 3rd respondent to consider and decide. Therefore, this Court at this stage has not https://hcservices.ecourts.gov.in/hcservices/

expressed any view on the claim made by the petitioner. However, as the petitioner has made a representation on 13.07.2015 to the 3rd respondent seeking for grant of patta, it is for the 3rd respondent to consider the same and pass orders on merits and in accordance with law.

4.Accordingly, this Writ petition is disposed of only by directing the 3rd respondent to consider the said representation of the petitioner and pass orders on merits and in accordance with law, within a period of one week from the date of receipt of a copy of this order. No costs.
