ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the third respondent herein to dispose the petitioner's Appeal in A1/12571/2025 dated 02.12.2025 in respect of the petitioner's family property in S.No.1162 to an extent of 11.29.0 Hectares situated at Eenjar Village, Sivakasi Taluk, Virudhunagar District.
2. The petitioner is a descendant of the Sivagiri Zamin, and the petitioner claims right over the property of the Sivagiri Zamin estate. The Government has taken over some of the Sivagiri Zamin properties through G.O.Ms.No.1047, dated 08.05.1941. However, in respect of Survey No.1162, the petitioner claims entitlement to an extent of 11.29.0 hectares. According to the petitioner, the respondent has incorrectly classified the said extent as Kadambankulam Kanmani. Hence, the petitioner seeks to conduct an enquiry and thereafter rectify the error and record Survey No.1162, admeasuring 11.29.0 hectares, in the name of the petitioner as Zamin land.

3. However, the respondents submitted that if the land is a water body, the same cannot be granted to the petitioner. The petitioner, however, submitted that even during the SLR, the land stood in the name of the Sivagiri Zamin and at no point of time, it was classified as a water body. Hence, the petitioner seeks rectification of the same

In view of the above, the respondents are directed to consider the petitioner's application dated 02.12.2025 and pass appropriate orders in accordance with law within a period of four months from the date of receipt of a copy of this order. During the enquiry, the respondent is directed to ascertain the extent of Kadambankulam Kanmani during the SLR and and retain the same as a water body. If any portion of the land belongs to the petitioner, the same may be granted. It is made clear that the water body shall be maintained as water body.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
