Respondents Prayer :- Writ Miscellaneous Petition filed under Article 226 of the Constitution of India, praying this Court to issue an order of INTERIM DIRECTION directing the 3rd Respondent to give adequate police protection to enable the petitioner to take her and her childrens belongings and essential goods from her permanent residence at No.7/2, Anna Colony, Mothirappa Chavadi, Thanjavur 613 001 and forbear the 6th and 7th respondent or their men, agents etc from interfering into the peaceful existence of the petitioner and her children and her family members pending disposal of the above writ petition and thus render justice.

Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a writ, order or direction in the 1/3

nature of a WRIT OF MANDAMUS or any other appropriate writ, directing the Respondents 1 to 5 to provide adequate armed police protection to the life and liberty of the petitioner and her family members and to take appropriate legal actions against the 6th and 7th respondent and their hooligans for giving life threat to the petitioner and for intimidating the petitioners mother by considering the petitioners representation dated 05.05.2021 and to pass such further or other orders as this Honourable Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER:- This Writ Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Kannan, Advocate for the Petitioner and of Mr.M.Muthumanikkam, Government Advocate(Crl. Side) for the respondents, this Court made the following order:

This petition is filed, seeking for a direction to the third respondent to give adequate police protection to enable the petitioner to take her and her children's belongings and essential goods from her permanent residence at No.7/2, Anna Colony, Mothirappa Chavadi, Thanjavur - 613 001 and to forbear the sixth and seventh respondents or their men, agents etc., from interfering into the peaceful existence of the petitioner and her children and her family members.

2.The learned counsel for the petitioner would submit that the sixth respondent developed illegal intimacy with the petitioner's husband, due to which, the sixth respondent and her hooligans continuously are making life threat to the petitioner and her mother. The learned counsel would further submit that the sixth and seventh respondents along with hooligans have prevented the petitioner from taking the essential goods from her permanent residence at No.7/2, Anna Colony, Mothirappa Chavadi, Thanjavur - 613 001 and hence, police protection may be furnished to the petitioner to take her belongings from her residence. 3.The learned Government Advocate (Crl.Side) appearing for the respondents 1 to 5, on instructions, would submit that the respondent police are ready to provide adequate police protection at the time of taking her essential goods.

4.Considering the facts and circumstances of the case and the submissions of the learned counsel on either side, the petitioner is permitted to take her belongings from her residence, after completion of the pandemic lock down period. The petitioner shall intimate the date and time, on which she intends to take belongings, to the respondent police. On such intimation from the petitioner, the respondent police are directed to provide adequate police protection to the petitioner, only at the time when she takes her 2/3

belongings from her residence.

5. With the above direction, this MP is disposed of.
