ORDER

The above Transfer Civil Miscellaneous Petition has been filed by the wife seeking transfer of the case in H.M.O.P.No.233 of 2017, which was filed by the respondent/husband from the file of the learned Sub Court, Thoothukudi to the file of learned Sub Court, Valliyoor, Tirunelveli District.

2.From the records, it appears that the petitioner has been contesting the H.M.O.P by filing a counter and also filing an application seeking interim maintenance. The petition appears to be at an advanced stage in trial and at this stage, if the petition is transferred, it would cause unnecessary delay. 3.In the above circumstances, while disposing of this petition, a direction is given to the learned Sub Court, Thoothukudi to ensure that the cross-examination of the petitioner herein, before the Court, should be concluded on the same day, when she come to adduce evidence and there shall be no adjournment, on the said date. 4.This transfer civil miscellaneous petition is dismissed, with the above directions.

No costs.

Consequently, connected miscellaneous petition is closed.
