Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to issue passport to him by considering petitioner passport application in File No. MD2076271941426 within the period fixed by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The writ petition is filed for a mandamus directing the 1st respondent to issue the passport to the petitioner vide application in File No.MD2076271941426.

2. Heard Mr.R.Tamil Vanan, learned counsel appearing for the petitioner, Mr.P.Arun Jayaram, learned Central Government Standing Counsel, who takes notice for R1 and Mr.K.Gnanasekaran, learned Government Advocate (Crl.Side), who takes notice for R2.

3. When the matter came up for hearing today, the learned Central Government Standing Counsel appearing on behalf of the 1st respondent would submit that in view of the receipt of the adverse police report, the issuance of passport has been kept pending.

4. The learned Government Advocate appearing on behalf of the 2nd respondent would submit that a case in Cr.No.28 of 2024 was registered against the petitioner for the alleged offences under Section 294(b) and 447 of IPC and the investigation is complete and now the matter is pending before the learned Judicial Magistrate, Vilathikulam in S.T.C.No.530 of 2024.

5. The law in this regard is well settled that the mere pendency of a criminal case is not a bar to the issuance of a passport. However, the petitioner is required to obtain permission from the concerned Court before proceeding further

6. In view thereof, this writ petition is ordered on the following terms:- i.

The petitioner's File No.MD2076271941426 shall be considered for renewal of the passport of the petitioner as expeditiously as possible and the same shall be issued to the petitioner within a period of eight weeks from the date of receipt of a web copy of the order, if there is no other impediment.

ii. The petitioner shall take the permission of the learned Judicial Magistrate Vilathikulam S.T.C.No.530 of 2024, before leaving abroad.

iii. No costs.
