RESPONDENT/ PETITIONER/ WIFE Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to withdraw IA.No.1 of 2019 in HMOP.No.57 of 2018 on the file of learned Subordinate Judge, Theni and transfer the same to the file of learned Family Court, Dindigul to be tried along with the HMOP.No.81 of 2018 on the file of the Family Court, Dindigul and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.SARVAGAN PRABU, Advocate for the petitioner, the court made the following order:- This petition is admitted only for the limited purpose of knowing whether the matter can be settled amicably between the parties, who are the husband and wife. The wife has filed a petition for divorce on the ground of desertion in H.M.O.P.No.81 of 2018 on the file of the Family Court, Dindigul. The husband has filed a petition in H.M.O.P.No.57 of 2018 on the file of the Subordinate Court, Theni, for restitution of conjugal rights. https://hcservices.ecourts.gov.in/hcservices/

2.This is a peculiar case, where, the husband and wife has alleged desertion as a ground for filing the respective H.M.O.P. Having regard to the intention they have exhibited in their petitions, it is a matter for settlement.

3.Issue notice to the respondent returnable by 24.06.2019. Private notice is also permitted.

4.Post the matter on 24.06.2019.
