Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/Accused No.1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 340 and 506(i) of the Indian Penal Code, in Crime No.240 of 2016 on the file of the respondent police, seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. He further submitted that earlier this Court granted interim anticipatory bail to the petitioner for a period of two weeks in Crl.O.P(MD)No.4666 of 2016, as the respondent has submitted that petition enquiry is pending. Subsequently, when the matter came up for hearing on 31.03.2016, the respondent submitted that a case has been registered against the petitioner and hence, the said petition was closed. He would further submit that the present case has been registered against the petitioner on the false allegations made by the defacto complainant and hence, he https://hcservices.ecourts.gov.in/hcservices/ prays that the petitioner may be enlarged on anticipatory bail.
3. The learned Government Advocate (Criminal Side) submitted that investigation is pending in this case and if the petitioner is granted anticipatory bail, he will tamper the witnesses and hence, he prays for dismissal of this petition.
4. Considering the fact that if the petitioner is released on anticipatory bail, he will tamper the witnesses and the custodial interrogation of the petitioner is very much essential, since the huge amount has not been recovered, this Court is not inclined to grant anticipatory bail to the petitioner and this Criminal Original Petition is dismissed.
