PRAYER:- Transfer Civil Miscellaneous Petition is filed under Section 24 of C.P.C of 1908 to withdraw G.W.O.P.No.102 of 2019 on the file of the Principal District Sessions Judge, Trichy and transfer the same to the Principal Sessions Judge, Madurai. J U D G M E N T

This application is filed to transfer G.W.O.P.No.102 of 2019 from the file of the Principal District Sessions Judge, Trichy to the file of the Principal Sessions Judge, Madurai. This application is filed by the wife and the minor is in the care and custody of the respondent/father who is residing within the jurisdiction of the Principal District and Sessions Judge, Trichirappalli. The minor is ordinarily residing within the jurisdiction of the Principal District and Sessions Court, Trichy.

2. In these circumstances, this transfer civil miscellaneous petition cannot be ordered since the ordinary residence of the minor is the sine qua non for filing the G.W.O.P.

3. In the result, this Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
