The writ petition was filed for for the issuance of a Writ of Mandamus, directing the respondent to cancel the patta. This Court, after considering the rival submissions directed the third respondent to consider the petitioner's representation dated 18.11.2024 and 31.12.2024. Based on the above order, the respondents have passed an order. However, the petitioner contended that this Court had specifically directed the Revenue Tahsildar to pass the order, but the order has been passed by the Revenue Divisional Officer, thereby depriving him of his appellate remedy.
2. This Court is of the considered opinion that cannot be the ground to hold that the respondent has committed contempt. Further, on perusing the affidavit filed in the writ petition, it is seen that the petitioner is relying on a release deed and claims that the same was executed without consideration. According to the petitioner, the sibling is not having any power to settle the same in favour of his wife. Such issues needs an elaborate scrutiny by perusing the evidence which the Revenue authorities cannot do. Therefore, the said contention cannot be accepted. If the petitioner is aggrieved by the order passed by the respondent, he is at liberty to challenge the same before the revisional authority and also before the competent Civil Court.
