PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to cancel the fake passport obtained by the 4th respondent viz., Justin in Passport No.G8447003 and consequently to issue a fresh passport in petitioner's name by considering his representation dated 03.11.2023.

ORDER
The present writ petition has been filed seeking a mandamus directing the first respondent to cancel the fake passport obtained by the 4th respondent in Passport No.G8447003 and for a consequential prayer to issue a fresh passport in the name of the writ petitioner by considering his representation dated 03.11.2023.
2. When the petitioner applied for a passport, the authorities have found out that using his credentials, the petitioner's brother, namely, the 4th respondent has obtained the passport. Therefore, the respondents 1 and 2 have refused to issue the passport on the said ground.
3. As far as the request of the petitioner to cancel the fake passport of the 4th respondent is concerned, it is for the 4th respondent to initiate appropriate action. In fact, the petitioner has lodged a complaint on 29.01.2026 before the 2/4
3rd respondent police regarding the fake passport obtained by the 4th respondent and FIR has been registered in Cr.No.44 of 2026. Therefore, it is for the respondents 1 and 2 to initiate appropriate action as against the 4th respondent if they found that the 4th respondent had obtained the fake passport.

As far as issuance of fresh passport to the petitioner is concerned, since the petitioner has already lodged a police complaint, and he contended that he has never obtained any passport in his name, it is open to the respondents 1 and 2 to consider the request of the petitioner for issuance of the passport based upon his application dated 03.11.2023. On being satisfied with the credentials of the petitioner, the respondents 1 and 2 are directed to issue the passport to the writ petitioner within a period of four weeks from the date of receipt of a copy of this order.
5. With the above said observations, this writ petition stands disposed of. No costs.
