ORDER
(Order of the Court was made by N.Seshasayee, J.) Mr.M.Mohaboob Athiff, learned counsel takes notice for the respondent.
2. By consent, the matter is taken up for final disposal.
3. The petitioner herein is working as Grade-II Bench Clerk at Sub-Court, Tiruchendur and he was served with a charge memo for the alleged misconduct of misplacing of case bundle while he was working as Grade-III Bench Clerk at District Munsif Court, Tiruchendur and the same is now pending before the respondent in D.E.No.2 of 2022. The petitioner only seeks expeditious disposal of the said domestic enquiry.
4. This Court is informed by the learned counsel for the petitioner that enquiry part is completed and the enquiry report has also been made available to the respondent and that, the petitioner has also been required to give his explanation to the findings of the enquiry report and the same too has been complied with by the petitioner. This Court understands that the entire process has been completed by 01.11.2022.
5. It is very apparent that the Damocles Sword of domestic enquiry is hanging on the head of the petitioner almost for sixteen months. Fairness in proceedings includes right to expeditious disposal of anything that feeds anxiety of a litigant.
6. In these circumstances, this Court directs the learned Principal District Judge, Thoothukudi, to come out with his decision in D.E.No.2 of 2022, on or before 30.04.2024.
