Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A2, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 324, 427 and 307 of IPC r/w Section 4 of Tamilnadu Prevention of Tamil Nadu Women Harassment Act in Crime No. 150 of 2016 on the file of the respondent police and hence, seek anticipatory bail.

2.The learned counsel for the petitioners submitted that the injured had already been discharged from the hospital on 15.03.2016 and there is no possibility to suffer due to impact of the injury. The petitioners are ready to produce substantial sureties as directed by this Court. Hence, the petitioners may be released on anticipatory bail.

3.The learned Government Advocate (Crl.side) appearing for the State submitted that the first accused had attacked with arival and caused injuries on the head of the defacto complainant and he produced the copy of FIR. He would further submit that investigation is pending and if the accused are released on anticipatory bail, they will tamper the witnesses.

4. On reading of Fir, it is seen that Kuppusamy the second accused instigated to cut the deceased and the first accused Prabhu caused injuries on the parietal region and cervical spine and they https://hcservices.ecourts.gov.in/hcservices/

damaged the two wheeler worth about Rs. 2 lakhs.

5. In view of the above facts, this Court is not inclined to grant anticipatory bail to the petitioners at this stage. The petition is dismissed.
