RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to pass an order permitting the petitioner to deposit cash of Rs.5,00,000(Rupees Five Lakhs Only) to the credit of Crime No.19 of 2021 of Respondent police before the learned Judicial Magistrate Court No.1,Tirunelveli instead of the already deposited document and consequently direct the learned Judicial Magistrate No.I, Tirunelveli to return the document already deposited (i.e Registered settlemtn deed dated 25.11.2021) on receipt of Rs.5,00,000 (Rupees Five Lakhs only) in Crl.OP(MD).21560/2022 dated 10/01/2023. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.KANNAN.V.

, Advocate for the petitioner and of Mr.B.THANGA ARAVINDH, Government Advocate(crl.side) on behalf of the Respondents the court made the following order:- This Criminal Miscellaneous Petition has been filed to pass an order permitting the petitioner to deposit cash of Rs.5,00,000/- to the credit of Crime No.19 of 2021 of Respondent Police before the learned Judicial Magistrate Court No.1, Tirunelveli instead of already deposited document and consequently direct the learned Judicial Magistrate No.1, Tirunelveli to return document already deposited (ie., registered settlement deed dated 25.11.2021) on receipt of Rs.5,00,000/- in Crl.O.P.(MD)No.21560 of 2022 dated 10.01.2023.

CRL MP(MD) No.6135 of 2023 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondent.

3.Considering the facts and circumstances of the case, the petitioner is permitted to deposit a sum of Rs.5,00,000/- to the credit of Cr.No.19 of 2021 before the learned Judicial Magistrate Court No.1, Tirunelveli. On deposit of the above said amount, the learned Judicial Magistrate Court No.1, Tirunelveli is directed to return the original document, which was already deposited. 4.Accordingly, the Criminal Miscellaneous Petition is allowed. sd/- 18/04/2023 / TRUE COPY / /04/2023 Sub-Assistant Registrar (C.S.)
