O R D E R

This Criminal Original Petition has been filed for a direction to the respondents not to harass the petitioner in Crime No.718/2012 on the file of the Kaliyakavilai Police Station, Kanyakumari District without adhering to the mandatory provisions of law contemplated under Section 41(A) of the Code of Criminal Procedure.

2. When the matter was taken up for hearing, the learned Government Advocate (Criminal side) submitted that this petitioner is an accused in Crime No.712 of 2012, which was initially registered under Section 174 of Cr.P.C., and the same has been altered tunder Section 306 of I.P.C. and final report has been filed before the learned Judicial Magistrate No.I, Kuzhithurai and the same has not been taken on file.

3. Since regular case has been registered against the petitioner, the prayer for not to harass cannot be granted. Accordingly, this petition is dismissed.
