For Respondent : Mr.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.256 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 341, 427 and 506(i) of IPC, in Crime No.256 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that there was a landlord and tenant dispute between the petitioner and the defacto complainant and the allegation is that the petitioner had trespassed, abused the defacto complainant in filthy language and intimidated him. Hence,the compliant.
3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent police. 4.Considering the above facts and circumstances of the case and also considering the impact of Covid-19 pandemic situation and the 1/3
consequent efforts not to congest the prisons, this Court is of the view that the arrest of the petitioner at this point of time is not necessary and not warranted in the interest of public at large, hence, this Court is inclined to grant anticipatory bail to the petitioner on certain conditions.
5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest by the respondent police on executing personal bond for a sum of Rs.5,000/- [Rupees five Thousand only] with two sureties each for a likesum to the satisfaction of the respondent police and on further condition that the petitioner shall appear before the learned Judicial Magistrate, Manaparai, and execute a fresh personal bond for a sum of Rs.5,000/- [Rupees five Thousand only] with two sureties each for a likesum to the satisfaction of the concerned Judicial Magistrate, within a period of one month, from the date of resumption of regular work in subordinate Courts in view of the present pandemic situation and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b]the petitioner shall report before the respondent police as and when required for interrogation;
[c]the petitioner shall not abscond either during investigation or trial;
[d]the petitioner shall not tamper with evidence or witness either during investigation or trial;
[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; and [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
