For Respondent : Mr.S.Ravi, Standing Counsel for Government PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.10 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Sections 406 and 420 IPC in Crime No. 10 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner received a sum of Rs.1,00,000/- from the defacto complainant by giving a false promise that he will make arrangements for getting a job in the Cargo Department of Airport, Madurai and thereafter, he failed to make arrangement for job and also refused to return the money. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that this is the second anticipatory bail application. He would further submit that the petitioner and the defacto complainant are close friends. Hence, he seeks anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Standing Counsel for Government appearing for the respondent would submit that the petitioner cheated the defacto complainant by giving a false promise and therefore, he vehemently opposed to grant anticipatory bail to the petitioner. 5.It is seen that the earlier application was filed by the petitioner came to be dismissed on 19.05.2021, for the reasons stated that the custodial interrogation of the petitioner is required since serious allegation is levelled against the petitioner. The second anticipatory bail application came to be filed on the ground that due to pandemic situation the petitioner is undergoing medical ailment and the learned counsel for the petitioner has also given an undertaking that the petitioner received only Rs.50,000/- from the defacto complinant and he is ready to pay the same.

6.However, I find no change of circumstance in this petition and the custodial interrogation of the petitioner is required. So, this Court is not inclined to grant anticipatory bail to the petitioner.
